Legal and terms
Just like every other website design service we have to have a few legal bits and some terms to help protect both you and ourselves
Below is a sample of our standard 5 page website contract which will be sent to you for signing during the site building process. If you have a bigger site or more features then the contract will be altered to fit your site build requirements.
Please read this standard contract.
1.a] We, wonderful-sites.co.uk agree to build, design and host your site and provide you with a free .co.uk domain name provided that you the customer both agree to and actually subscribe to our service paying the subscription stated below for the full period of the subscription(1.b).
1.b] You the customer stated above agree to pay the monthly sum of £ 5 for a minimum term of 24 months.
2.a] Up on completion of the stated subscription period you are released from this contract and then have the option to take the site to another hosting company or remain with us. The domain name will be released to you though you must pay any renewal fees due.
2.b] Should you choose to move site hosting then at least 2 months notice must be given, even if the subscription period is due to expire.
2.c] If you choose to remain with us at the end of the stated subscription period you must pay the renewal fee for the domain name before it will be released to you.
2.d] You may cancel your subscription at anytime and one of the following will happen;
2.e] If you cancel without warning and /or without good reason after the site has been submitted for indexing we will retain the domain name and suspend the hosting of your site, after one month without payment we reserve the right to remove your site from our servers and retain the domain name which we subsequently would seek to sell to another party or parties.
2.f] Should you cancel your subscription after the site has be submitted for indexing and giving us at least one months notice and pay to us at the time of the notice the sum of £50 which will cover our build fee then the domain name will be released to you and the site will remain being hosted for a period not exceeding 2 months in total to enable you to transfer - at your expense - the site to another server, after that period we reserve the right to charge in advance the sum of £3 for hosting per month or part month. Failure to pay either of the two fees stated would result in clause 2.e or 2.g (whichever one applies) being invoked.
2.g] Should you cancel during the build time of your site (prior to indexing request) without good reason, then all work on your site will end and the site will be removed from our servers and we will retain the domain name. You will be charged £10 per hour or part hour for the time spent building your site and will be charged £10 for the contact form set up (this is to cover the fees or the form processors)
3.a] You the customer will supply all page content and pictures which must be your own property or if supplied free from a stock site then you must inform us of the licence agreement conditions and supply us with the necessary information to comply with the licence agreement.
3.b] You the customer are responsible for insuring that all page content is accurate and none offensive.
3.c] We reserve to right to remove any site that contains any pornographic material, offensive content, racial or anti religious content, or any material we do find acceptable or do not feel is accurate or may be misleading to the internet user. Download sites or site promoting illegal downloads are not allowed and will be removed immediately and penalties stated in condition 2.g will apply no matter if the site has been submitted for indexing or not.
4.a] You will supply the page contents in the manner laid out in the how it works pdf.
4.b] We will use all acceptable material you supply to build your site reserving the right to return the material to you for editing should we feel changes should or could be made. (this is to mainly for your SEO).
5.a] We will endeavour to build your site to your requirements subject to the content reaching our standards and will take all reasonable action to comply with your requests provided that the requests are within the limits of the package you have subscribed to.
5.b] You the customer agree to pay for any additional expense which may be incurred for installing extra features or programs you require on your site not covered by the subscription a non-exhaustitive list of examples of such features that may well incur extra fees are forums, password protected pages, members areas, specialised site software, non PayPal shopping carts, additional contact form..
5.c]Included in your package is a free .co.uk domain name, the stated number of pages your site will contain, one contact form, maintaining or SEO service (if requested and subscribed too) the creation of up to 3 pdf documents. Any additional items may carry an additional charge.
5.d] Any additional features required for your site should be requested prior to the commencement of the subscription. This is to allow us time to check that our servers will support such applications and that we can indeed ultimately install the required feature.
6.a] Control of the domain will remain with us until the minimum period of the subscription is met or the release fee is paid upon cancellation.
6.b] The login details to the site will be release to you the customer once the site has been submitted for indexing or occasional prior to this at your request. This is purely to prevent you the customer from either accidentally or deliberately interfering with the site or the site building procedures.
6.c] We will submit a request for indexing on your behalf to Google and Yahoo (indexing can only be requested and can take up to 6 weeks to occur if successful) we do request indexing by any other search engines as part of our service, you the customer are free to do so if you so wish and at your own expense.
7.a] The site is deemed to be under your control once a request for indexing has been made and from that point on you the customer will be responsible for its maintenance unless you have subscribed to our site maintaining service.
7.b] Non subscribers to our site maintaining service who wish to have us perform any work on their site or on a site related matter will be charged a hourly rate for the work payable in advance and currently charged at £10 per hour or part hour if the request for the work is made after a indexing request has been made.
7.c] Once a request to index has been made no work what so ever will or should be carried out on the site until the site is indexed. Customers are advised that to alter any site during a indexing request period could seriously effect their chances of having the site indexed.
7.d] Prior to indexing you will be given the opportunity to review the site and request any alterations be made by us. Following this review and the completion out of any alterations requested by you at the time of the review the site will be then submitted for indexing and you the customer will assume at that point full responsibility for the site and all its content.
8.a] SEO services customers who subscribe to our SEO service will be deemed to have authorised us to add relevant reciprocal links to their links page.
8.b] You the customer also agree to alter any text or page content that might reasonable conceive as being detrimental to your page ranking. If we make such a request we will endeavour to maintain the theme of the content. Such request will normally only be made in cases where we believe that keyword richness or content is adversely effecting the sites search ranking.
8.c] Though we will endeavour to improve your sites search ranking you are made aware that climbing the rankings is a long and slow process which to achieve the best possible results requires you the customers' full co-operation. We at wonderful-sites are dedicated to achieving the highest possible ranking for our customers sites though high ranking cannot be guaranteed by us or any other SEO company.
9.a] If you already have your own domain name then no reduction in the basic subscription fee will be afforded to you.
9.b] If you have your own domain name then we reserve the right to restrict access to the site until such time as we see fit or you complete the minimum subscription period laid out above or pay the release fee.
10.a] Adding additional pages not covered by your original subscription fee is allowed provided that you first seek our permission and agree to pay the additional subscription rate currently £1 per month per extra page.
10.b] you may, once the site has been submitted for indexing and having been handed over to you, build and add your own pages if you so wish. Should you then seek our assistance with the addition for what ever reason a fee of £10 will be charged plus and hourly rate of £10 for a full or part hour which will need to paid as a one off sum. We reserve the right to charge this up front before we assist you with this request.
10.c] Should you be found to have added extra pages with content or added content to existing pages that is not allowed (as previously defined) then you will have your hosting immediately suspended and a suspension fee of £20 will become payable which will need to be paid before the site is re-instated. The offending contents and/or pages will have to be removed by you before any re-instatement of hosting will be allowed.
11.a] Sub domains are not allowed.
12.a] We as part of our service will monitor your bandwidth usage and will undertake to increase your bandwidth allowance as traffic to your sites increases. This service applies to all sites hosted by us and is free of charge provided you account is in good order.
12.b] We reserve the right to decrease your bandwidth if we feel you have an excessive amount allocated to your site in relation to your actual site traffic, we will then increase the bandwidth allocation as laid out in 12.a.
13.a] Contact forms are at the moment subject to a one off set up fee by our form processors and we pay that for you as part of your subscription fee. As the processing company has a clause reserving the right to introduce processing charges then we also reserve the right to pass any future charges on to you.
13.b] We will endeavour to source another form processing company before we pass any future form processing charges on to you and we reserve the right to pass on any future set up charges on to you should we feel they would offer a better rate to you. If this not possible we will invoke condition 13.a.
14.a] Your subscription fee will not rise during the agreed minimum subscription term provided the conditions remain the same throughout the entire subscription period and provided that we do not incur the additional charges as laid out in condition 13.a or 13.b or your request additional pages or features be added to your site. The charges for addition features or services are liable to change without notice.
14.b] Once your minimum subscription period has ended and provided that your account is in good order we will revise your subscription amount and offer you the revised amount for another 24 month period. You have the right to refuse the offer and move your site to any server at the time of the revised subscription. We in turn have the right to refuse to host your site after the minimum subscription period has ended without giving reason.
14.c] If it is our intention not to host your site after the end of the initial subscription period we will give you 2 months notice of our intention not to do so.
15.a] All fees must be paid in good time and where requested in advance we do not offer credit facilities.
16.a] Wonderful-sites.co.uk or it is owners will not be deemed liable for any failure in service, site content, any purchases, or the functions of any features or software applied to your site. It is you the customers responsibility to insure the correct functionality of all features of your site including payment systems. This includes third party applications and software.
17.a] Every page built by us for your site must contain a credited link to us and in return we will place a link to your site on our links page. Removal of this credited link by you will result in your subscription fee being doubled or your site removed from our servers with no refund of subscription fees.
17.b] We will make the credit link as discrete as possible whilst maintaining a visible presence.
17.c} The credit link may be removed from you at the end of the minimum subscription period or upon you the customer paying the release fee or site building fees in full and making a request to have them removed.
18.a] This contract is subject to the laws of England.
